This article examines the judicial writing of one of Michigan's finest writers. Born in 1903, John Donaldson Voelker lived virtually all of his 87 years in Ishpeming in the Upper Peninsula. He loved life in the U.P. and left only for three years of law school in Ann Arbor and three rather unhappy years practicing law in Chicago. He "didn't like living in the big city," and felt "the very anonymity of city life is dangerous to the human animal. " During the long U.P. winters, Voelker wrote eighty articles and short stories, four novels, and seven other books. He joked that "if we had fishing all year round, I would never have written a book." All of the books and almost all of the stories were authored under the pseudonym Robert Traver. While all of Voelker's life will be examined, this article focuses on the three-year period when Voelker wrote one hundred opinions, not as Robert Traver but as Justice John D. Voelker of the Michigan Supreme Court. Voelker's judicial writing will be described in the context of a literary life that eventually lured him from the court. Most of Voelker's opinions follow the conventional style of a jurist in a state appellate court. But, at times, he breaks from legal convention and writes judicial opinions that sparkle with the wit and literary flair that characterize his novels and short stories. Many of the most memorable passages from his opinions will be quoted here.
