In the final analysis, the financial records of county courts are subject to public review despite the judiciary's exemption as a public body as stated in the Michigan Freedom of Information Act. The financial records are available under several different legal theories. First, the records are available under Articles 9 and 23 of the Michigan Constitution, which state "financial records, accountings, audit reports and other reports of public moneys shall be public records and open to inspection." Secondly, they are available under Michigan common law which holds "[t]he fundamental rule in Michigan on the matter before us, first enunciated in the case of Burton v. Tuite, (1889), 78 Mich 363, is that citizens have the general right of free access to, and public inspection of, public records." Finally, they are also available under Michigan Supreme Court Administrative Order 1997-10 which states, "[u]pon a written request that describes an administrative record, an employee record, or a financial record sufficiently to enable the Supreme Court administrative agency to find the record, a person has a right to examine, copy, or receive copies of the record."
