摘要

Miliary operations in Afghanistan and Iraq have propelled the issue of detention operations to the forefront of our national discourse. Not since the internment of thousands of Japanese-Americans during World War II has the question of wartime detention played such a significant role in formulating our foreign policy, military strategy, and our constitutional construct. After seven years of armed conflict, the question of who to detain during hostilities and with what procedural safeguards remains unanswered. What was once legally and ethically straightforward has now become complex and nuanced.
