The European Commission has the power to propose new regulations, change existing regulations and issue guidance on the interpretation of legislation, but up until now with a clear disclaimer that it is the prerogative of the courts to interpret the law. The Commission also has the power to inspect member states to verify that they have implemented the legislation correctly. All this is well established and does not cause concern. However, the extension of these powers into the jurisdiction of the courts is raising fears that the Commission is now interpreting legislation and acting as judge and jury.
