摘要

As Ohio goes, so goes the nation, in wetland regulatory policy as well as in politics. Ohio has been a national leader in implementing thoughtfully constructed, science-based regulation of wetland protection, including arguably the most comprehensive wetland water quality standards of any state. But in the case of wetland mitigation policy, as the nation goes, so goes Ohio. The 2008 U.S. Army Corps of Engineers' (Corps') Mitigation Rule put wetland mitigation banking at the top of the hierarchy for preferred mitigation methods. This was based on the demonstrated effectiveness of mitigation banks at providing centralized, ecologically successful mitigation with the proper stewardship to be maintained and protected in perpetuity.
