An advantage of use - risk - assessment in connection with the authorization of plant protection products is mandatory. In the area of the assessment of the influence of pesticides on the environment the necessity of an advantage of use - risk - assessment is expressly stipulated in the Council Directive 91/414/EEC and, following the Directive, in Section 15 of the German Crop Protection Act and applicable by way of interpretation in conformity with existing law and - to the extent there is a conflict in the wording - against the express wording of the lower ranking Uniform Principles.%Eine Nutzen-Risiko-Abwägung bei der Zulassung von Pflanzenschutzmitteln ist grundsätzlich geboten. Im Bereich der Bewertung von Umweltauswirkungen ist die Nutzen-Risiko-Abwägung in der Richtlinie 91/414/EWG und ihr folgend in § 15 Pflanzenschutzgesetz ausdrücklich verankert und gegen den etwa entgegenstehenden Wortlaut der niederrangigen Uniform Principles im Wege der gesetzeskonformen Auslegung anzuerkennen und vorzunehmen.
