This article looks into the question of the legal basis and status of Article 138(1) of the Rules of the International Tribunal for the Law of the Sea, which provides that an international agreement related to the purposes of the Law of the Sea Convention may specifically give to the Tribunal the authority to give an advisory opinion on a legal question. Although there are several provisions on the advisory functions of the Deep Seabed Disputes Chamber in the United Nations Convention on the Law of the Sea (the LOS Convention) and the Statute of the International Tribunal for the Law of the Sea (the ITLOS Statute), the advisory jurisdiction of the International Tribunal for the Law of the Sea (ITLOS) per se is not expressly dealt with in either the Convention or Statute.
