Article 76 of the UN Convention on the Law of the Sea prescribes the procedures to be followed by wide-margin coastal states in determining the outer limits of their extended continental shelves beyond 200 nautical miles. A state that chooses to implement Article 76 must demonstrate to the satisfaction of the Commission on the Limits of the Continental Shelf that it meets the bathymetric and geological criteria set forth in the Article. This validation process involves only two parties: the state itself and the Commission on the Limits of the Continental Shelf. There is no provision for disclosing to affected or otherwise interested third parties the scientific rationale that underlies a given state's proposed outer continental shelf limit, the supporting information at its disposal, or the Commission's reasoning in approving or disap-proving the limit. Nor is there a mechanism that permits other states to lodge formal objections to outer limit determinations that might affect their legitimate interests. Given the plethora of ambiguities that characterize Article 76, it is suggested that this lack of transparency could impair the credibility of the overall process and jeopardize the acceptance of its conclusions by other states. A recommended solution would involve: (a) requiring states to disclose fully and publicly the rationale and the information from which their proposed outer limits are derived; (b) making interested parties privy to the deliberations of the Commission on the Limits of the Continental Shelf; and (c) instituting a process whereby affected states could seek clarification of the grounds for a state's proposed outer limits. There is reason to believe that these procedures could be implemented with the approval of the Meeting of States Parties, preferably before the Article 76 process leads to the establishment of outer shelf limits that are "final and binding."
