The Third Circuit U.S. Court of Appeals denied Berks County's petition alleging the misplacement of air quality monitors in Berks County by the Pennsylvania Department of Environmenetal Protection did not produce an accruate reading of lead particles in the vicinty of Reading. The county directly appealed the agency's final action. Berks countended that an air quality monitor in Laureldale North was not properly situated to detect maximum lead concentrations from the Exide Techologies plant. Instead, monitors should have been placed in a former convent which Exides itself had used to detect lead, it said.
