The Third Circuit U.S. Court of Appeals vacated on Sept. 29 the U.S. Environmental Protection's 2014 Final Rule that approved Pennsylvania's source-specific analysis determining of the best available retrofit technology (BART) for major sources of pollution that are anticipated to cause visibility impairment in any Class Ⅰ area pursuant to federal Clean Air Act. "In the end, the EPAhas identified a host of problems with Pennsylvania's BART analysis. What it has not done, however, is provide a sufficient explanation as to why it overlooked these problems and approved Pennsylvania's State Implimentation Plan (SIP). Because we, as a reviewing court, need an agency to show its work before we can accept its conclusions, we will remand this case to the EPA for further consideration."
