Wolf son of the District of New Jersey held on Oct. 29 that the theory of constructive consent to sue has been overruled and the Rivers and Harbors Act does not provide the explicit waiver of sovereign immunity necessary for John F. Dempsey to bring a claim against the U.S. Army Corps of Engineers (USAGE) over the scheduled dredging of the Shark River channel in Monmouth County that has not occurred.
