The Environmental Hearing Board held on Aug. 15 that a letter in which the Department of Environmental Protection stated that the department will determine what "appropriate remedial work" on natural gas wells will be undertaken by Chesapeake Appalachia LLC pursuant to a consent order does not constitute a final action and is not appealable.
