Although Mark West's arguments have drifted into the irrelevant and inconsistent, the Council has shown clearly and logically that the proper analysis for determining what, if any, protections are made available to discoverable documents must duly consider the public's interest in maintaining an open discovery process. Very little that Mark West has argued before the Board, whether case law or affidavits, would suggest that Mark West's private interest in confidentiality would trump the public interest in this case. In contrast, the Council has demonstrated that its need for access is great while the harm to Mark West is overstated and minimal. As such, the Council asks the Board to exercise its discretion in discovery to grant the Motion to Compel and deny Mark West's Motions for Protective Order for all but the most sensitive documents.
