New natural gas pipeline construction is at risk of a standstill. A U.S. District Court in Arizona rejected a natural gas company's right of immediate possession of the property necessary to begin construction before the federal condemnation process is complete.rnThe court's decision in Transwestern Pipeline Company, LLC v. Various Tracts of Land, requires the pipeline company to wait until the amount of just compensation is determined and paid before it begins construction of its pipeline on any property that is in dispute. This is one of the first courts to take this position despite a long line of cases led by the U.S. Court of Appeals for the Fourth Circuit's decision in Sage v. East Tennessee Natural Gas. Does this signal a change in the law or is this simply one court that got it wrong?rnThe Natural Gas Act gives interstate natural gas companies the federal power of eminent domain to condemn the easements necessary to construct new facilities. That Act, however, does not specifically provide the gas companies with immediate use and possession of the properties so that construction can begin soon after the issuance of a certificate of public convenience and necessity from the Federal Energy Regulatory Commission (FERC). Natural gas companies have-long used the equitable powers of the federal courts as the avenue to gain immediate access to the property. Without access to the property, construction cannot begin.
