In tweaking its definition of avoided costs to allow states to npromote the development of favored generation types through nfeed-in tariffs, the Federal Energy Regulatory Commission was nrecognizing the need to let the application of federal law evolve nto reflect those goals, Commissioner Cheryl LaFleur, FERC’s nnewest member, said last week.nFERC’s October 21 order was an evolution of its interpre-ntation of the Public Utility Regulatory Policies Act, LaFleur nexplained at a Washington news event co-hosted by the nAmerican Wind Energy Association and the Compete Coalition. nUnder the avoided cost provisions of PURPA, a utility must buy npower from a qualifying facility at the cost it otherwise would nincur to generate or buy the next increment of capacity.
