Electric industry stakeholders are continuing to ring in nwith the Federal Energy Regulatory Commission on the issue nof whether the right of first refusal for incumbent transmission ndevelopers should be lifted from federal rate schedules or agree-nments — a proposal floated by FERC in its proposed new rules nfor transmission planning and cost allocation.nFERC is starting to sift through a hefty round of reply comments non the subject, which reiterate unsurprising positions: Independent ntransmission developers support a lifting of right of first refusal, or nROFR, while transmission-owning utilities say that doing so would ncreate problems and stifle transmission development.n A number of state utility commissions, renewable energy ndevelopers, consumer groups and public interest groups have nfiled with FERC in favor of lifting the ROFR provisions.nLS Power Transmission, a developer that wants to build the n160-mile, 345-kV LaSalle transmission line to relieve congestion nbetween Illinois and Indiana, has been a strong player in the ndebate over lifting the incumbents’ right.
