As utilities try to figure out their next steps after a federal court threw out the Clean Air Interstate Rule last month, the only thing clear so far is that a legislative plug for that regulatory hole looks impossible this year. The member of Congress who stepped up immediately with a proposal to fix the problem created by loss of the rule, Democratic Senator Thomas Carper of Delaware, conceded last week that even if there were a great deal of agreement on an emissions package, the state of Congress right now is such that almost any action is tough to get.
