The Sierra Club last week sued Dynegy and other developers of the Sandy Creek power plant alleging that it would emit mercury and other hazardous air pollutants without adhering to requirements under the Clean Air Act. The environmental group is seeking an injunction to halt construction of the 900-MW pulverized coal plant near Waco, Texas, and for civil penalties to be levied against Sandy Creek Associates, a limited partnership through which Dynegy affiliates and the LS Power Group own 64% of the plant. Other owners include Brazos Electric Power Cooperative, with 225 MW, and Lower Colorado River Authority, with 100 MW. Sierra Club said in its complaint, filed in US District Court for the Western District of Texas, Austin Division, that construction of Sandy Creek began in January without a determination that the facility would satisfy the federal law's requirements for "maximum achievable control technology" to limit its emissions of mercury and other hazardous air pollutants, or HAPS.
