In oral arguments last week, a federal appeals court judge said he was "having trouble" with one of the most controversial aspects of the Federal Energy Regulatory Commission's backstop transmission corridor siting rule - the agency's assertion that Congress gave FERC authority to approve a power line project when a state commission has lawfully rejected the application. One of the primary issues in debate before the US Court of Appeals for the 4th Circuit in Richmond, Virginia, was whether FERC correctly interpreted congressional intent and the language of the Energy Policy Act and the Federal Power Act in asserting that the term "withheld approval" - referring to state action - endows FERC with authority to override a state's denial. Also before the court was whether FERC's orders violated the requirements of the National Environmental Policy Act.
