Federal regulators, attempting to disprove notions that their generation market power tests are geared to punish those not in regional transmission organizations, said last week that two utilities in the Northwest — a region not even developing an RTO — passed the tests. At the same time, the Federal Energy Regulatory Commission at its open meeting Wednesday initiated investigations into two other utilities — Tampa Electric and Empire District Electric — that are not members of functioning RTOs and that failed the agency's tests.
