Japan’s revised nuclear liability law is drawing criticism from nuclear specialists for not requiring the country’s utilities to hold sufficient funds for adequate compensation in the event of a nuclear accident. The revised law, which passed in the Diet, Japan's parliament, December 5, also maintains nuclear plant operators’ current unlimited liability for compensation for accidents, leading to objections from the power companies. The role of government financial responsibility for the compensation in the law is another issue that should be reviewed, the specialists said. After more than three years of discussions, Japan Atomic Energy Commission, which reports to Japan’s Cabinet Office, drafted an amendment of the Nuclear Damage Compensation Law. The revised law was changed little from the previous version. Adopted in 1961 to ensure compensation to accident victims and support nuclear plant operators, the nuclear liability law has been revised five times, roughly every 10 years, with the compensation amount that utilities are required to hold gradually rising to Yen 120 billion ($1.06 billion), an amount that remained unchanged in the version approved this week. This compares with an initial level of Yen 5 billion set in 1961, according to JAEC.
