After almost 11 years, countless parliamentary debates and numerous false starts, the Corporate Manslaughter and Corporate Homicide Act 2007 finally becomes law on April 6 2008. In the following article, Rhian Gilligan sets out the implications for the power generation sector. The legislation introduces the new offence of corporate manslaughter, bringing with it the potential for significant financial penalties coupled with remedial and publicity orders and abolishing the need for wrongdoing within the "controlling mind" of the company before a manslaughter conviction can be founded.
