This book does not really need a review, because it does exactly what it says on the label: it gives English doctors and lawyers a practical guide to assessing mental capacity. This is most especially a concern for psychiatrists. Other clinicians can normally expect that their clients are able to decide for themselves whether to consent to treatment -there may be odd exceptions, such as an accident victim brought in unconscious in urgent need of a blood transfusion and with no evidence as to whether he is a Jehovah's Witness, but by and large physicians merely have a legal duty to make reasonably sure that the patient is broadly aware of the risks and implications of treatment and can then get on with it. Psychiatrists, more or less by definition, deal with people who may not have the capacity to make decisions. In fact, whenever such a problem arises, the immediate reaction of most physicians is to run bleating for help to the nearest psychiatrist. A case arose recently of a woman who refused kidney dialysis on the grounds that "life had lost its sparkle". The nephrologists immediately felt out of their depth and called in the psychiatrists even before they called in the lawyers. (The patient died anyway, but the law seems to be that assisting someone to commit suicide is a crime in England and Wales, but people with the capacity to make decisions may refuse treatment even if they know this will lead to their deaths.)
