Michael Appleby's In Court Analysis in the January issue raised an interesting question on the recently published consultation paper on sentencing for corporate manslaughter. However, I feel he failed to present a reasoned argument for his final statement that "if s not too late for the Sentencing Advisory Panel to wake up and smell the coffee".rnWhile the assertion that "a sentencing regime based on turnover would arguably amount to a change" is correct, I'm not sure that it applies in this case. It is arguable that the proposed guidelines do no more than reinforce the current sentencing regime by giving the judge an appropriate starting point for applying the guidance found in R v F Howe & Sons, in which the Court of Appeal recognised force in the public disquiet that health and safety fines had been too low, and that the size of a company was not relevant to the standard of care expected of it.
