This article aims to deepen our knowledge of legislation and social practice relating to the establishment of the principle of free soil in Spain, as considered in the case of a black African slave from the West Indies called Rufino. The court's decision in this case became a fundamental pillar of abolitionist legislation. The immediate precedent had been set by the Royal Order of 29 March 1836, whereby slaves brought to the Peninsula were declared to be free.
