"I want to [talk] about the two contracts that ICO entered into on July 25, 2003 - the contract that set up a new price for the satellites, and the contract that resolved, irrevocably in the words of the contract, the disagreement... on the Delta 3 [launch vehicle]. On one level this case is about those two contracts. But at another level it's about something very different and fundamental. It's about their unwillingness to take responsibility for their decision to enter into these contracts. And it's about ICO's unwillingness to accept responsibility for its decision to invest in the first place in a very risky business ... Every day, businesses enter into contracts. And every day somebody on the other side of the table relies on those decisions. Sometimes those decisions turn out great and people make gazillions of dollars. Sometimes they don't turn out so well and when that happens, you can't just walk away from the deal... ICO was hardly some small, unsophisticated company that was taken advantage of by Boeing. It is run by very rich, very savvy, very intelligent and sophisticated people. They read the contract. They studied the contract. Their board of directors authorized them to enter into the contract ... They knew what they were doing ...
