Congress recently amended the Open-Market Reorganization for the Betterment of International Telecommunications (ORBIT) Act to permit Intelsat to satisfy the statutory requirements for privatization through a private equity sale rather than through an initial public offering (IPO) of its equity. While this decision was the subject of more than a little controversy, Congress made exactly the right decision both for Intelsat and for the satellite services market. Intelsat, of course, began life as an intergovernmental organization designed to provide satellite communications services all across the globe. Back in the 1960s, private entities had neither the incentive nor the money to launch and fund a global satellite system for global telephony. Only governments or government designated entities could handle the task.
