Space law is bifurcating. The public international law of space has set the stage on which commercial enterprise by both state and private actors is developing, not to say booming. National legislation, rules and practices are being elaborated to cope with what are often multinational or international enterprises. Thirty years ago one might have thought that US domestic law would supply most models for that development. However, this has not happened. For a variety of reasons the USA has not made the inroads into international business that was expected back then. US laws apply to US endeavours, but generally not to non-US enterprise if US entities are not involved. Others have seized the opportunities and, as a result the expertise of other legal traditions is contributing to the creation of what can be called the private law of space. In particular, European cooperation, mediated through a variety of devices and arrangements, has made Europe a significant participant in space activities.
