At his inauguration in January 2009, US President Barack Obama sought to draw a line between his administration and a White House that had unlawfully spied on its citizens, established secret prisons and embraced torture. 'We reject as false', he declared, 'the choice between our safety and our ideals.'1 Presenting the security dilemmas of a modern state as a choice between its safety or its ideals is indeed false, but the 'enduring convictions' of which Obama later spoke do evolve over time. The new threats posed by terrorism, the opportunities offered by technological innovation, and the acceptance of a public willing to compromise its privacy have changed the context within which such decisions on national-security matters are made.
