Among President Barack Obama's first acts was to announce the closure of the detention facility at Guantanamo Bay and strict limits on the Central Intelligence Agency's interrogation authority. These announcements were greeted in the United States and Europe alike with euphoria among critics of the George W. Bush administration, who saw them as signalling an end to the entire 'global war on terror' paradigm.1 Until recently, many Bush administration critics viewed its legal arguments, premised on a 'global war' concept, as political and ideological opportunism and therefore likely to be overturned through electoral realignment: as with the Iraq War, the new administration would wind down the anti-terror war, and therefore open a path toward restoring transatlantic harmony in combating common terrorist threats.
