Viviane Reding, the EU commissioner for Information Society and Media, declared in September 2006 that "the most effective and least bureaucratic way to achieve a real level playing field for telecoms operators across the EU would ... be by an independent European telecom authority". Last month, the European Regulators Group (ERG), a body set up by the European Commission to encourage cooperation between itself and national regulatory authorities (NRAs), issued a response firmly rejecting this view. Instead, the ERG members support better use of the existing legislative framework to harmonise communications rules and regulations across Europe. Despite the existence of compelling arguments against the creation of a pan-European regulator, the commissioner is unlikely to concede the issue, as certain member states continue to fail to properly regulate their markets. However, if a centralised regulator is to be established, more detailed consideration must be given to the ability of such a body to regulate national markets, as well as compliance and the EU principle of proportionality.
