Opta has suggested that the market should help resolve two of the most controversial topics in European tele-coms today, local exchange shut-downs and the Openreach model. In a letter dated March 2, the Dutch regulator outlined two potentially influential conclusions. One, that KPN should take a leading role in reaching a compromise with local-loop un-bundlers on how it might phase out its local exchanges. Two, that imposing the Openreach-style separation of the Dutch incumbent's access network could have an undesirable effect on competition, but that a voluntary commitment by the operator to certain aspects of the model could be welcomed. OPTA had originally planned to issue rules about now for KPN's groundbreaking plans to shut down its local exchanges as part of the rollout of its next-generation access network. However, die regulator suspended these plans in late January, after concluding that the current options for access to the new network would not allow existing levels of competition to continue. In March 2 letter, OPTA gives KPN around three months to agree new options with alternative operators, which OPTA will consider as part of its draft analyses of the unbundled and wholesale-broadband-access markets due to be published by end-2Q07. Significantly, the letter suggests that KPN should hold bi- and multilateral meetings, in which OPTA would take only a monitoring role.
