This article was originally published in the March 2002 edition ojThe Army Lawyer. Since that time it has been cited more frequently than any other appearing in this publication written by a judge advocate. Lieutenant Colonel (Retired) MacDonnell joined the Army in 1987 as an Air Defense Artillery Officer. He was accepted in to the Funded Legal Education Program and attended law school at Suffolk University Law School, graduating in 1999. After serving for fourteen years as a judge advocate he retired from the Army and joined the faculty at Washington and Lee University School of Law where he is now an Associate Clinical Professor of Law and the Director of the Advanced Administrative Litigation Clinic.
