Would you expect to pay less for a vehicle if you knew it had been involved in an accident - even if it had been repaired to its original factory condition? In law, so-called 'diminution' describes the loss in the value of goods arising from a breach of a duty of care, typically, the loss of resale value to a vehicle damaged within a road traffic collision. Cases of diminution have seen a 300% increase in the last 12 months according to Horwich Farrelly. Unsurprisingly this rise has led to an increased appetite from insurers to challenge this potentially costly element of a claim. Diminution claims are grounded in the legal principle 'restitutio ad integrum'. In simple terms this means any calculation of compensation should restore the claimant to their original position, assuming the accident had never occurred.
