Federal law places three requirements on agencies when interacting with lactat-ing employees. First, the FLSA requires agencies to grant non-exempt employees reasonable breaks in a private area (other than a bathroom) for the purpose of expressing milk. Second, the FMLA requires agencies to grant up to 12 weeks of continuous leave per year to care for the birth of a child. Third, agencies must refrain from discriminating against lac-tating employees in violation of Title VII. Chiefs are also encouraged to carefully review the laws of their respective states, as an increasing number of states have created additional regulations.
