摘要

RESIDENTS living along the route of the mothballed Stoke-Leekbrook Junction line in Staffordshire are objecting to the impending reopening of the line on the grounds that it has in effect become "a town or village green" on which members of the public have become used to walking - even though they have been trespassing in order to do so! Moorland & City Railways Ltd is planning to clear the track of vegetation and use it to connect the Churnet Valley heritage railway and the recently-reopened Caldon Low freight line to the Network Rail system at Stoke-on-Trent, but resistance is coming from the village of Endon. The railway's supporters, including Michael Fell OBE, are objecting to the 'village green' application on the grounds that the 1863 ex-North Staffordshire Railway line has never been legally abandoned, that it has been left intact pending possible use for its original purpose and that trains have used it as recently as May 1994 - well within the 20-year period stipulated in Section 15 of the Commons Act 2006.
