摘要

In 1997 RUSI held a debate on the issue of - possible pardons for soldiers executed for military offences. The debate was chaired by Sir Michael Howard. By and large, the delegates agreed that his summing up of the position was both magisterial in its clarity and its acknowledgement of the position: Where the law of the land - as it stood at the time - was correctly followed at the time, then we cannot re-invent the past to suit ourselves. However if the law of the land, as it stood at the time, was not followed at the time, then those cases should be re-examined to see if a pardon is appropriate.
