In slightly more than two decades, the Endangered Species Act (ESA) has gone from being one of the least controversial laws enacted by Congress to one of the most contentious. The ESA, passed by a nearly unanimous vote in 1973, now is a target for major revision, if not elimination altogether. Proponents of the status quo insist that it is a necessary tool to safeguard the nation's biological diversity. Critics argue not only that the act is costly, inflexible, and contemptuous of private property rights, but that it fails to protect endangered species. Unanimity long since has dissipated.
