EPA is urging a federal appeals court to reject environmentalists' lawsuit seeking to require the agency to update its Clean Water Act (CWA) effluent limits for slaughterhouses, saying the agency's 2019 public statement calling for more study on the issue is not a final agency action and therefore the court lacks jurisdiction to hear the case. The agency's statement, contained in an October 2019 preliminary effluent limitations guidelines (ELG) plan "is not a final agency action for two reasons, either of which, standing alone, constitutes grounds for dismissing the petition for review," EPAsays in a Sept. 30 brief to the U.S. Court of Appeals for the 4th Circuit. Under the Administrative Procedure Act, only final agency actions are reviewable in federal court.
