A top Army Corps of Engineers official is downplaying Senate Republicans' claims that memos between EPA and the Corps prove their argument that the agencies'joint Clean Water Act (CWA) jurisdiction rule is unlawful due to a lack of inter-agency consultation, with the Corps saying the memos were only part of a broader, adequate review. Sen. James Inhofe (R-OK) argues that the memos that the Corps recently provided him in response to a recent request show that EPA failed to fully consult with the Corps on the rule. "[T]he facts in these documents support my conclusion, and the conclusion of the 30 states that have already filed lawsuits challenging the final [CWA] rule, that the rule is lacking factual, technical and legal support," Inhofe says in a July 27 letter to the Corps.
