Epa's plan to quantify the "value of water" is raising industry concerns that the agency could eventually use its upcoming study to bolster its legal case for regulating isolated wetlands and other waterbodies that it may not currently regulate or strengthen oversight of already regulated waters. The water office study, which the agency is scheduled to begin discussing with its Science Advisory Board (SAB) Dec. 5, "could start the process of the agency laying the ground work that under the Commerce Clause [they] should be able to regulate all water," an industry source says. The source adds that EPA could use its study to bolster the case for a new guidance and rulemaking that could expand the definition of navigable waters that are regulated under the Clean Water Act (CWA). "We expect that to be the case," the source says. Industry sources say the agency's study could also prove controversial because the agency is planning to consider "non-use," recreational and other non-market values that often result in large, subjective valuations. On Dec. 5, SAB's specially augmented Environmental Economics Advisory Committee is scheduled to hold a teleconference to review and provide input to the agency about the approach the agency is taking in its project, titled "Estimating the Value of Water to the U.S. Economy," as well as an overview document and a list of potential expert papers that could be included in the report.
