摘要

The Agreement on Trade-Related Aspects of Intellectual Property Rights (The TRIPS Agreement), concluded during the Uruguay Round negotiations, has led to some changes in the development of pharmaceutical industries. The TRIPS Agreement, which came into effect on 1 January 1995, sets out the minimum standards of protection for all WTO Members. As the TRIPS Agreement implies a substantial increase in terms of patent protection, this paper intends to deal with the following research question: Does a higher standard of patent protection under the TRIPS Agreement have a positive impact on pharmaceutical industries in developing countries? This paper attempts to compare the welfare effects of patent protection on the pharmaceutical industries in China and India. Such a comparison study is possible for two reasons.
