Posting hyperlinks to publicly available, unauthorized copies of Playboy's photos is not copyright infringement under European law, an Advocate General of the European Court of Justice wrote April 7 (GS Media BV v. The AG's advisory opinion to the European high court came in response to a request from the Supreme Court of the Netherlands for guidance on the EU directive relating to copyright harmonization (Directive 2001/29). If the court adopts the opinion, it could be a setback for copyright owners who struggle to stop online infringement.
