摘要

An Australian business that used Facebook, Twitter, You-Tube, and other California-based services to facilitate its infringement of Korean plaintiffs' copyrights purposefully directed its activities toward California, supporting the exercise of specific personal jurisdiction and the issuance of a default judgment there, the US District Court for the Northern District of California ruled on December 21 (DFSB Kollective Co v. Tran, ND Cal, No. 11-1049, 12/21/11). Although no party in the case is located in the United States, let alone California, Judge Lucy H Koh found the defendant's use of California-based online services provided the minimum contacts required for the court's exercise of personal jurisdiction to comport with federal due process and California long-arm requirements.
