A recent ruling by the Paris High Court (Tribunal de Grande Instance de Paris) revisits the various legal issues that arise in connection with Google's famous (notorious?) AdWords programme.rnThe programme's modus operandi is, by now, well known: it allows advertisers to make bids on so-called key words such that when the relevant word is queried in Google's search engine the winning advertiser's link appears alongside (or above) the natural or organic search results. The result is that it is entirely possible for advertiser A, who has no rights to a term that is itself a protected trademark, to buy the term and to therefore present its advertisement when a user searches that term.
