It would appear that global business is trapped in a vicious cycle, that starts with a corporate collapse and is speedily followed by a government inquiry and weighty legislative compliance requirements. Enron and Worldcom gave birth to Sarbanes-Oxley, HIH and OneTel gave birth to CLERP 9. However, is this regulatory regime likely to prevent an employee from committing fraud, stop money laundering or miraculously transform the decision making processes of an unethical organisation? In the view of the National Business Development Manager at SAI Global, John Feeney, at least part of the answer rests with independent verification and not regulatory suffocation. According to Mr Feeney there is a battle raging between regulators and global business, regulators want safeguards while business wants freedom to produce profits with out the burden of prescriptive compliance requirements. So how can big business win back the confidence of the regulators?
