Kelemua Mulat was a 39 year old asylum seeker who died after delays to her cancer treatment amid confusion overwhethershe was eligible for free NHS care (This Week, 28 September). Regardless of whether migrants in England are deemed eligible, they are exempt from upfront charging for all NHS services if the treatment is considered "urgent" or "immediately necessary." Treatment for metastatic cancer is clearly immediately necessary. Clinicians must be aware of this exception to upfront charging because, although the hospital's overseas manager determines eligibility for free care, an assessment of urgency can only be made by a clinician. Mulat finally received chemotherapy because doctors exDressed concern.
