As a result of the nullification of S 27IV HRG (a federal framework'faw on higher education) by the Federal Constitutional Court, the prohibition to charge tuition fees for studying for a first degree at a German university was lifted. Therefore it is now for the individual federal states to decide whether they wish to introduce tuition fees or not. Fees for "normal" first degree students do not, as a rule, infringe the Constitution, provided that their height is appropriate and does thus not keep anyone from beginning their studies. This is also true for the federal state of Hesse, although Art. 59 H V (Hessian Constitution) states a general ban on school or tuition fees. Unlike these general tuition fees, special fees for long-term students have already since a few years been introduced by several federal states. They may - at least in Hesse - infringe the constitutional rights of the students concerned if the hardship clauses are insufficient or if the general exclusion of retroactive effects is not respected. A third category of tuition fees are those which are charged for studying for a second degree after having finished or given up a first subject. The way these fees are regulated in Hesse, they can also have unallowed retroactive effects or infringe the principle of equal treatment, which is guaranteed by Art. 3 I GG (Basic Law), because the criteria which are used for differentiating between certain groups of students are partly inappropriate. Finally, S 64a HHG (the Hessian law on higher education) makes the students pay a contribution to the university's administrative costs. In its current form, this regulation is unconstitutional. Firstly, the Hessian parliament did not have the legislative authority to pass this law because there is no reasonable balance between the amount to pay and the service rendered in return. This disproportion secondly violates the students' fundamental rights stated in Art. 121 GG (the freedom to choose a career) or at least in Art. 2 I GG (the general freedom of action).
