The Competition Act of 1998 is enforced by the Consumers and Markets Authority (ACM). The Ministry of Economic Affairs and Climate Policy appoints the ACM's directors, though the agency operates as an independent agency. Legislation that took effect in 2016 raised the maximum fines the ACM can issue for violations of any of the laws it enforces. The maximum fine doubled to €900,000 from €450,000, or 10% of annual sales, whichever is higher. For cartel violations, the fine depends on the length of the offence, with a maximum of four years. (This means fines can reach as much as 40% of the company's annual turnover in cartel cases.) Any recidivism within five years doubles the fine automatically.
