On 2005, after an eight-year legal battle, the Supreme Court struck down laws in Michigan and New York that allowed in-state wineries to ship directly to consumers while prohibiting out-of-state wineries from doing the same.In the Granholm v. Heald case, Michigan-based wine writer and collector Eleanor Heald, along with 11 other plaintiffs, sued Michigan officials (including Gov. Jennifer Granholm) for violating the Commerce Clause of the United States Constitution. The same argument was made in a separate case against the state of New York by Juanita Swedenburg, along with other owners of out-of-state wineries. On May 16, 2005, the Court ruled that the existing laws discriminated against out-of-state wineries and therefore violated the Commerce Clause.
